Terms of Service

§1. General provisions

1.1. These Terms set out the rules for using the tophat.pl website and the conditions for providing services electronically by the Service Provider.

1.2. The Service Provider is Tomasz Turmowicz, operating a sole proprietorship under the name „tophat.pl — agencja kreatywna”, with its registered office at ul. Warszawski Świt 12B/1, 03-368 Warsaw, Poland, NIP 7142026846, REGON 384762554.

1.3. Contact with the Service Provider: kontakt@tophat.pl.

1.4. These Terms are made available free of charge at tophat.pl/en/terms. Every User may download, save and print them.


§2. Definitions

  • Site — the website available at tophat.pl together with all its subpages.
  • Service Provider — Tomasz Turmowicz, operating under the name „tophat.pl — agencja kreatywna” (details in §1.2).
  • User — any natural person, legal entity or organizational unit using the Site.
  • Services — the free services provided electronically described in §3 (browsing the Site and the contact form).
  • Contact form — an interactive form for sending an inquiry to the Service Provider.
  • Privacy Policy — the document describing the rules for processing personal data, available at tophat.pl/en/privacy-policy.

§3. Type and scope of services provided electronically

3.1. Through the Site, the Service Provider provides the following Services free of charge:

  • Browsing the Site’s content — service descriptions, portfolio, blog, contact details,
  • Contact form — sending an inquiry or message to the Service Provider.

3.2. Using the Services does not require registering an account or providing any data other than what the User enters themselves in the Contact form.

3.3. The Site is not an online store — it does not allow purchasing services online or concluding a contract by submitting the Form. Specific projects are always carried out on the basis of a separate agreement concluded off-Site.


§4. Technical requirements

4.1. To use the Site properly, the User should have:

  • a device with internet access (computer, smartphone, tablet),
  • a current version of a web browser (Chrome, Firefox, Safari, Edge — released within the last 12 months),
  • JavaScript enabled (required for the Contact form to work),
  • technical cookies enabled (see Privacy Policy, §7).

4.2. The Service Provider makes every effort to keep the Site continuously available, but does not guarantee the absence of interruptions caused by technical maintenance, updates or factors beyond its control (e.g. an outage on the hosting provider’s side).


§5. Contact form and inquiry status

5.1. Sending a message via the Contact form does not constitute a contract or an obligation on either party — it is merely an expression of interest in cooperation.

5.2. After receiving an inquiry, the Service Provider usually responds within 2–3 business days by email to the address provided in the Form.

5.3. Further cooperation, including the scope of work, deadlines, remuneration and payment terms, is always agreed individually and confirmed in a separate agreement concluded in written or documentary form (e.g. an exchange of emails accepting the offer).

5.4. To submit the Form, the User must accept the data processing terms in accordance with the Privacy Policy.


6.1. All content presented on the Site (text, graphics, designs, source code, animations, structure, layout) is the intellectual property of the Service Provider or is used under appropriate licenses.

6.2. The portfolio presented on the Site contains work done for the Service Provider’s clients — published with the clients’ consent. Copyright to specific projects is governed by a separate agreement between the Service Provider and the client.

6.3. Copying, modifying, distributing or commercially using content from the Site without the written consent of the Service Provider is prohibited.

6.4. The above does not exclude the possibility of lawful quotation (Art. 29 of the Polish Act on Copyright and Related Rights).


§7. Complaints

7.1. Complaints regarding the functioning of the Site (e.g. technical errors, problems with the Contact form) can be submitted to kontakt@tophat.pl.

7.2. A complaint should include: a description of the problem, the contact details of the person submitting it, and the date of occurrence.

7.3. The Service Provider reviews a complaint within up to 14 days of receiving it and informs the User of the resolution by email.

7.4. Complaints regarding the delivery of specific projects (commissioned graphic work, code, copywriting) are governed by the separate agreement under which the work was carried out.


§8. Personal data protection

8.1. The rules for processing personal data collected by the Site (in particular through the Contact form) are described in detail in the Privacy Policy available at tophat.pl/en/privacy-policy.

8.2. By using the Site and the Contact form, the User confirms that they have read the Privacy Policy.


§9. Final provisions

9.1. The Service Provider reserves the right to amend these Terms in the event of changes in the law, the way the Site functions, or the scope of Services provided. We will inform you of any change by publishing a new version of the Terms at tophat.pl/en/terms with the current date.

9.2. In matters not regulated by these Terms, Polish law applies, in particular:

  • the Civil Code,
  • the Act of 18 July 2002 on the provision of electronic services,
  • the Act of 4 February 1994 on Copyright and Related Rights,
  • the GDPR and the Personal Data Protection Act.

9.3. Disputes arising from use of the Site are resolved amicably by the parties. Failing agreement, the competent court is the common court with jurisdiction over the Service Provider’s registered office. Consumers may use out-of-court dispute resolution methods — details are available at uokik.gov.pl and via the European Commission’s ODR platform: ec.europa.eu/consumers/odr.

9.4. These Terms enter into force on the day of their publication on the Site.
